Acceptable use policy

Easynic.com supports the fair use of the Internet in partnership with our resellers. We operate a zero tolerance policy towards spam, malicious activity and/or the abuse of our services.

Acceptable use policy is in addition to Easynic.com Terms and Conditions (TCs).

By signing up and using our Service(s) you agree not to, or to allow your customers to do any of the following:

  1. Use of Services

    1. Easynic.com reserves the right to suspend or cancel a Reseller's or Customer’s access to any or all Service(s) provided by Easynic.com, where Easynic.com decides that the account has been inappropriately used. Easynic.com reserves the right to refuse Service(s) and/or access to its servers to anyone.
    2. Easynic.com will suspend access to, or cancel, an account which:
      1. Contains invalid or fraudulent details.
      2. Initiates a payment card chargeback.
    3. You agree;
      • not to resell or offer for the use of third parties any part of our Service(s), unless you have purchased a reseller package or dedicated server.
  2. Hosting Acceptable use guidelines
    1. You may not use the Service(s):
      1. in any way that breaches any applicable regulation, UK or International law.
      2. in any way that is fraudulent;
      3. to host any material which is in breach of our content guidelines (see section 3);
      4. to transmit, or otherwise permit any unsolicited or unauthorised advertising or promotional material or any other form of similar marketing material ,also known as SPAM or Unsolicited Commercial Email (UCE)
      5. to publish or otherwise distribute copywriting or other illegal material. The onus is on You the customer to prove that You own the rights to publish material, not for Easynic.com to prove that You do not.
      6. to participate in any file-sharing/peer-to-peer activities;
      7. as a file backup store. All files uploaded to a domain on our servers must be visible and accessible by visiting that domain, unless they are hidden files needed to operate the website; we reserve the right to delete files which do not match these criteria without giving notice to you.
      8. to use the server as an application server. Using the server to generate large volumes of email from a database is an example of activity that is not allowed. Scripts should not attempt to manipulate the timeouts on servers. These are set at the present values to ensure the reliability of the server. Sites that reset these do so because they are resource intensive, and adversely affect server performance and are therefore not allowed. Scripts that are designed to provide proxy Services, anonymous or otherwise, are not allowed
      9. to use excessive amounts of server resources. These include bandwidth, processor utilization and / or disk space.
      10. to offer HTTP downloads from your site, other than where the files are directly related to the subject matter of the site. We recommend you stream any multimedia content including audio and video files. Any downloads offered by You under this clause are subject to sections 1.2, 2.1.6, and of this Acceptable Use Policy. Easynic.com reserves the right to archive any download content we do not believe to be necessary for the normal operation of the site, and the definition of this is entirely at the discretion of Easynic.com.
  3. Content guidelines

    1. These content guidelines apply to any and all services provided by Easynic.com to You.
    2. Material published to or transmitted through our servers must:
      1. be accurate (where stating facts);
      2. comply with applicable law in accordance with section 2.1 of this policy.
    3. Material must not:
      1. be defamatory of any person;
      2. be obscene, offensive, or inflammatory;
      3. contain any adult material. Adult material includes all pornography; or otherwise lewd or obscene content. The designation of 'adult material' is left entirely to the discretion of Easynic.com.
      4. infringe any copyright, or trade mark.;
      5. be likely to deceive any person;
      6. promote or assist any illegal activity;
      7. be threatening, abusive or invade another's privacy, or cause annoyance, inconvenience or needless anxiety;
      8. be used to misrepresent your identity or affiliation with any person or organization;
    4. You must ensure that any end-user submitted content such as forum posts or chat room entries meet with the standards defined within this Policy.
  4. Enforcement

    1. We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of Easynic.com Services. When a breach of this policy has occurred, we may take such action as we deem appropriate in accordance with section 1.1 of this Acceptable Use Policy.
    2. Failure to comply with this Acceptable Use Policy constitutes a material breach of our Terms and Conditions upon which you are permitted to use Easynic.com Service(s), and may result in our taking all or any of the following actions:
      1. immediate, temporary or permanent withdrawal of your right to use Easynic.com Service(s);
      2. immediate, temporary or permanent removal or archiving of any content in breach of our Content Standards (as defined in section 3 of this Acceptable Use Policy) uploaded to our servers;
      3. issue of a warning to you;
      4. issue of legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
      5. further legal action against you; or
      6. disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
      7. We exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.
  5. Email acceptable use policy

    Without exception, Easynic decries the practice of mass mailing unwanted email of any type, regardless of content, and we will do everything within our power to reduce the flood of this type of traffic across the Internet.
    We have the following policies (please see our definitions below):

    1. Easynic prohibits the use of our systems in any manner associated with the transmission, distribution, or delivery of spam.
    2. Any Easynic Email user who sends spam may have their account disabled and be disallowed further service.
    3. The reseller must take reasonable steps to ensure that it issues email accounts only to those who do not intend to use them for spam.
    4. The reseller must respond in a timely manner to any complaints about spam, and must make the needed contact information publicly available.

    If we believe that it is warranted, Easynic operations personnel have the option to immediately disable any account in order to forestall further abuse or damage to email systems. Should this occur, the reseller shall be notified as soon as possible.
    Spam sent from other networks which references an email account hosted at Easynic shall be treated as if it originated from the account referenced, unless there is sufficient reason given for Easynic operations staff to believe that the message truly originated with some unrelated party.
    Likewise, postings made to Usenet newsgroups or other online forums, such as blogs which reference email accounts hosted at Easynic, and are deemed to be inappropriate according to the local ethical standards of those forums, may be treated in the same manner as spam.

    Filtering of Incoming Email
    As the owner of the equipment and other resources utilised to provide services, Easynic has the legal right to block electronic communications from other entities on the Internet.
    Resellers should be aware that such blocking or filtering may take place if deemed necessary by designated members of the Easynic operations staff (or a third party chosen by Easynic and made known to the reseller).
    Whenever possible, the party being blocked shall be made aware of such action before it occurs.

    Mass Mailing
    Easynic does not support outbound mass mailing as a standard offering. As standard practice we limit users from sending mail to a large number of recipients per 24 hour period. This limit is restrictive on the first day of usage, and becomes more lenient over time. Users who reach this limit will experience error messages such as "Daily maximum exceeded".
    This limit is subject to change without notice, should our service be compromised. In order to protect our resellers we do not publish the numeric limit publicly.
    A reseller can request through the Easynic support organisation that this limit be overridden temporarily for a particular user. Each request will be evaluated on a case-by-case basis.

    File Sharing
    Easynic allows our Email Service customers to share files by uploading the files to Easynic File Storage and then sharing the links to those files. Customers who participate in file sharing must adhere to the policies outlined in this document.

    Easynic prohibits the uploading, sharing, or disseminating of any information, data, or material that is defamatory, child pornography, or hate literature, as well as any that is in violation of local, or international regulation or law, or that is prohibited by common law. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or any other statute.

    Easynic also prohibits the posting, storing, transmitting, or disseminating of any information or software that contains a virus, trojan horse, worm, defect, or any other harmful, contaminating, or disruptive components.

    Easynic reserves the right, at its sole discretion, to lock any account this is found to be in violation of this policy.

    Illegal Activities
    Services offered may only be used for lawful purposes. Transmission, distribution, or storage of any information, data or material that is in violation of federal or state regulation or law, or by common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or any other statute.

    Easynic reserves the right to cooperate with law enforcement and other legal authorities in investigating claims of illegal activity.

    Easynic will not release any information regarding our resellers (excepting that which is public knowledge, such as the InterNIC's WHOIS database) or their users to any third party, except upon presentation of a valid court order from a government or legal entity with proper jurisdiction. The reseller agrees that Easynic judgment as to the validity of any such order shall be considered proper and final.

    Right to Damages
    Easynic considers most instances of spam to be a theft of services, and reserves the right to prosecute originators in a court of law.

    Easynic reserves the right to collect damages (to cover software, hardware, and man hours) if any harm is done to our network or equipment that requires repair or reconfiguration of any kind. If deemed appropriate by Easynic, the reseller will be billed not less than £200 per individual complaint received by Easynic staff.

    In addition, Easynic reserves the right to collect punitive damages in recompense for any perceived loss of brand reputation. Nothing contained in this document shall be construed to limit action that Easynic may take or remedies that are available to us with respect to any of the described conduct.

    Easynic reserves the right to take any additional actions we may consider appropriate with respect to such conduct, including, without limitation, taking action to recover costs and expenses of identifying offenders and removing them from our network or systems, and levying cancellation charges to cover costs in the event of disconnection for the causes outlined in this policy document. In addition, Easynic reserves at all times all rights and remedies available to us with respect to such conduct at law or in equity. Non-enforcement of any policy or rule herein does not constitute consent or waiver, and Easynic reserves the right to enforce such policy or rule at its sole discretion.

  6. Mail Filter Fair Usage Policy

    1. While we appreciate you can't fully control the volume of spam directed at your mailboxes, pricing for our Mail Filter product is based on what we believe to be an acceptable level of mail traffic. Anyone who appears to be producing levels of mail traffic beyond what we class as fair, or recommended for the cost of the product, will be contacted.
    2. For our Mail Filter package, we consider Fair Usage to be no more than 1 million (1,000,000) emails being filtered in any one month. Accounts generating more than 1 million emails per month will be looked upon as having Unfair Usage levels and will be subject to being contacted by Easynic to review the terms of the package.
    3. We reserve the right to impose a charge for high mail filter usage if a customer is using email filtering in excess of our fair usage policy. Any account seen to be going over this level of email will be contacted with payments adjusted accordingly.
    4. Easynic will alert you via your given email address initially within 7 days, we will then attempt to call you on your provided telephone number, if after 15 (calendar) days the problem has still not been resolved, Easynic reserves the right to cancel the customers’ mail filter service if the above Fair Usage conditions are breached.
    5. This Fair Usage policy is applicable to full paying versions of our Mail Filter product.
  7. BANDWIDTH Fair Usage Policy

    1. We reserve the right to impose a charge for high bandwidth usage if a customer is using bandwidth in excess of our fair usage policy. In the event you require an additional bandwidth allowance, please contact the Easynic sales team. Easynic will alert you via your given email address initially within 7 days, we will then attempt to call you on your provided telephone number, if after 15 (calendar) days the problem has still not been resolved, we reserve the right to suspend your service.
    2. Webhosting : We consider reasonable usage on Web hosting to be:
      • StarterPlus & StarterPlus packages - 5 GB - 10GB of bandwidth suitable for a website that receives 5 million hits
    3. Dedicated Servers: We consider reasonable usage on Dedicated servers to be:
      • 100 - 200GB per month of bandwidth suitable for a website that receives 10 million hits
  8. Designer Unlimited Web Hosting Reseller package Fair Usage Policy

    1. Easynic.com may offer unlimited web hosting accounts with some reseller accounts subject to a fair use policy.
    2. Unlimited web hosting accounts are intended for direct use by the reseller and should not be resold or offered for resell by third parties. Unlimited hosting accounts require a domain name to be hosted with Easynic.
    3. Should the number of unlimited web hosting a single reseller provisions to the system negatively impacts the hosting platform, Easynic.com reserves the right to restrict the number of web hosting packages included in the reseller’s unlimited package. Charges may apply.
  9. General

    1. Easynic.com have a Police Liaison function and we are committed to assisting, and cooperating with, all law enforcement and government agencies in helping to reduce Internet Crime.
